Plaintiff did not comply with discovery. Trial court erred in allowing the evidence to be used at trial because eth evidence was not disclosed during discovery. Court here uses Rule 37(c), which excludes any evidence not disclosed. If this is your case, the attorney should bring the nondisclosure to the court’s attention and get a ruling on it before trial. This is called a motion in limine.
