Plaintiff sues for cargo loss and damage.  Plaintiff’s non-testifying expert immediately inspected the boat and made a report.  Defendant wants to get his grubby little hands on the inspection report.  Court here ruled for the plaintiff because there were no exceptional circumstances for the non-testifying expert, and the defendant could have done it himself.
