Marketable title- a title that is “reasonably free of encumbrances and other title defects,
and free from the risk of litigation. The notion is that a purchaser should not be
“compelled to purchase a lawsuit” along with the land. All definitions used by courts
involve the probability that a claim will be made or litigation initiated against the owner.
